Terms of Service

The following Terms of Use Agreement (“Terms of Use”) constitutes the terms and conditions that governs the use of the services offered by TownConnect (“Site”) by its customers (“User”). By using the Site, you thereby submit your acceptance of these Terms of Use which bind your conformation to establish a legal agreement between the User and the Site. Kindly discontinue your utilization of the Site and its services if you do not wish to agree to these Terms of Use, which are subject to change without prior notice to the User or any intimation thereof.

I.DEFINITIONS OF KEY TERMS

A. Clients: Any consumer looking for skilled labour-related services.
B. Contractors:  Any legally eligible individual or entity interested in provided skilled labour-related services. 
C. Contracts:  Project agreements between Clients and Contractors for the completion of a project.
D. Users or you:  Can be Clients, Contractors, or any visitor to the Site.

II. ELIGIBILITY

The Site and services of TownConnect are available exclusively to legal entities and/or individuals who are bonafide Citizens of the Republic of Ghana, and at least eighteen (18) years of age capable of forming legally binding agreements under applicable law.

III. CLIENT-CONTRACTOR RELATIONSHIP

The Site does not interfere in the interaction between the Client and Contractor as to amount of payment, deadlines, or services to be provided and in what manner. The Site’s primary role is to provide a place to match Clients with Contractors. Users are required to acknowledge and agree that TownConnect does not have any control over the quality, deadline, legality or any other aspect of the services or products delivered by the Contractor as well as the integrity, responsibility or other actions performed by the Contractor. 

TownConnect will not be liable in any case if any of our contractors mis-behaved with you during the work. However, we do all the background verification before employing them. Hence, we advise everyone to invite them only during the day timings when one of your family members is present at home.

IV. GENERAL GUIDELINES

Users may not use information originating from the Site for any purpose other than as originally intended. Users may not disrupt the proper function of the Site or engage in any activities that are (in TownLabour’s judgement) unlawful, harmful, threatening, violent, abusive, harassing, tortuous, defamatory, vulgar or otherwise objectionable. All Contractors are independent and are not employees or agents of TownConnect, nor are Contractors supervised or instructed by TownConnect. Accordingly, TownConnect is not liable for circumstances arising out of a Contract between Client and Contractor, nor responsible to address actions or omissions committed by the Users. Contractors hold no claims against TownConnect regarding employee pay, benefits, workers’ compensation or other employment issues of any kind.

V. DISPUTES BETWEEN CLIENTS AND CONTRACTORS

Each Client and Contractor agrees to hold TownConnect harmless , and out of any dispute or rendering payment (or refunds) subject to a dispute. TownConnect reserves the right to play no role in the dispute resolution process.

VI. GOVERNING LAW AND JURISDICTION

These terms shall be governed and construed in accordance with the laws of the Republic of Ghana and the courts of Yamunanagar, Haryana shall have exclusive jurisdiction on all matters and disputes arising out of and relating to the Site.

VII. INDEMNITY

The User should agree to indemnify and hold the Site, its officers, subsidiaries, affiliates, successors, assigns, directors, officers, agents, service providers, suppliers and employees, harmless from any claim or demand, including reasonable attorney fees and court costs, made by any third party due to or arising out of content submitted by the user, users use of the service, violation of the terms of use, breach by the user of any of the representations and warranties herein, or user’s violation of any rights of another.

VIII. MISUSE OF CREDIT/DEBIT CARD INFORMATION

TownConnect will not be responsible if any of your card information, for instance, your name, phone number, address or card number get misused. All the online transactions are made via the payment gateway CCAvenue. Hence, we don’t keep track of your personal data and all the information is stored by the payment gateway itself.

IX. REFUND POLICY

No refund transactions will be made in case if any of the work done by our one of the contractors gets undone after one or two days. We will not refund your amount. However, we can send our contractor to get the work done again.
